In Buenos Aires, Airbnb hosts must comply with a set of regulations as outlined by the local government under Law 6255, Resolution No. 138 / ENTUR / 20. Hosts are required to register their property for short-term rentals through the Tourism Entity of the City via the Remote Procedures system. This entails obtaining a registration number, which must be included in their Airbnb listings.
Key requirements include meeting health and safety standards such as having compliant electrical and gas installations, smoke detectors, fire extinguishers, and first aid kits. Additionally, hosts must ensure safety instructions and emergency contact information are clearly posted for guests. There are special provisions for hosting families with young children, which involve added safety measures for windows and balconies.
Hosts are also responsible for collecting the Urban Use Right (DUU) fee from non-resident guests over 12 years old, set at 75 US cents per day, and remitting it to the city government bimonthly.
To maintain guest safety and comfort, the regulation advises adhering to enhanced cleaning protocols, particularly in response to COVID-19, and ensuring child safety measures are in place when children are potential guests. Civic responsibilities include informing guests of house rules, building regulations, noise policies, and pet guidelines.
Lastly, hosts are encouraged to check their insurance coverage to ensure adequate protection, and they should be mindful of potential restrictions in condo bylaws or mortgage agreements that could affect their ability to offer short-term rentals.
